1. Acceptance of Terms
By accessing or using the FanC website (the “Site”) or purchasing products from FanC (“we,” “us,” or “our”), you agree to comply with and be bound by these Terms & Conditions.
If you do not agree to these terms, you may not access or use our Site or services.


2. Account Registration
  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • FanC reserves the right to suspend or terminate accounts for misuse, violation of our policies, or fraudulent activity.

3. Orders & Purchases
  • All orders are subject to product availability and acceptance at our sole discretion.
  • We reserve the right to correct pricing errors, cancel or limit quantities, and refuse orders that appear fraudulent.
  • Prices are listed in AUD unless otherwise stated, and exclude taxes, shipping, and duties where applicable.

4. Payment Terms
  • Accepted payment methods include major credit/debit cards, PayPal, and other methods displayed at checkout.
  • Full payment must be made at the time of purchase.
  • Orders with failed or incomplete payments may be automatically cancelled.

5. Shipping & Delivery
  • Delivery timeframes are estimates only and not guaranteed.
  • Risk of loss or damage transfers to the customer once the order has been handed to the carrier.
  • For international orders, customs duties, taxes, or import fees may apply and are the responsibility of the customer.

6. Returns & Refunds
  • Returns must be requested within 30 days of delivery.
  • Returned items must be unused, in their original packaging, and include proof of purchase.
  • Refunds will exclude original shipping costs unless the return is due to our error or a defective product.
  • Sale, clearance, or promotional items may be final sale unless required by Australian Consumer Law.

7. Product Warranty
  • FanC products come with a 12-month limited warranty against manufacturing defects.
  • The warranty does not cover damage caused by misuse, modification, accidents, or unauthorised repairs.
  • Warranty claims require proof of purchase and may require product inspection or return.
  • This warranty is in addition to rights provided under Australian Consumer Law.

8. Intellectual Property
All Site content — including logos, text, graphics, product images, and software — is the property of FanC and protected under copyright, trademark, and related laws.
You may not reproduce, distribute, or use any content without our prior written permission.


9. User Conduct
You agree not to:
  • Use the Site for unlawful or fraudulent purposes.
  • Upload viruses, malicious code, or engage in activities that disrupt Site functionality.
  • Infringe upon our or others’ intellectual property rights.

10. Limitation of Liability
To the fullest extent permitted by law, FanC shall not be liable for:
  • Indirect, incidental, or consequential damages (including loss of profit, data, or use).
  • Damages resulting from misuse or failure to follow product instructions.
  • Acts, errors, or omissions of third parties linked to or involved in delivery or Site operations.
  • Our total liability shall not exceed the purchase price of the affected product.

FanC is not responsible for the content, privacy practices, or operations of these third-party sites.


13. Dispute Resolution
Any dispute arising under these Terms will be resolved through binding arbitration in Queensland, Australia, in accordance with Australian Consumer Law.
You agree to waive participation in any class-action proceedings.


14. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
Any disputes or claims shall be subject to the exclusive jurisdiction of Queensland courts.


15. Changes to Terms
FanC reserves the right to update or modify these Terms at any time without prior notice.
Continued use of our Site following changes constitutes acceptance of the revised Terms.


16. Sever-ability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
